This article analyzes the evolution of the legal rules on exclusion of partners from limited liability companies by decision of the other partners, due to misbehavior. For this purpose, historical aspects of the experience in other countries are being examined along with the legal rules in effect in Brazil until enactment of the present Civil Code of 2002, followed by analysis of the solution brought by the 2002 Code in comparison to the rules of the previous 1916 Civil Code. The article concludes with a critical opinion on the current legal framework.
