(Re)Evaluation of the Criteria for Classifying Business Enterprises

This work examines the evolution of the criteria for classifying business companies. Particularly, I analyse the classic dichotomy between companies of people and companies of capital to demonstrate how these criteria have become more relative over time. I argue that at the current stage in the evolution of corporate law, the importance of the classification of companies as being formed of people or capital should be mitigate, since their nature rests much more on the substance of the relationship of the partners, in light of the circumstances that result from the dynamic of business life.
